How is property mutation done after an owner’s death in UP?

The successor or claimant reports the death and applies for mutation before the Tahsildar or the designated revenue office for the village and tehsil where the property is situated. The application is registered, notice is issued to recorded co-sharers and apparent heirs, and the revenue staff may prepare a report in the prescribed form.

Where no heir objects, the Tahsildar can amend the revenue record under the succession provisions of the U.P. Revenue Code, 2006. A mutation order is an administrative entry for revenue purposes. It is not a declaration that the applicant has exclusive ownership.

Documents required for dakhil kharij after death

The exact document list can differ between tehsils and between agricultural and urban property records. In Lucknow district, applicants should carry originals for verification and submit clear self-attested copies with a properly indexed application.

Step-by-step UP mutation procedure

The application should identify the property precisely: district, tehsil, village, gata or plot number, khata number, area, current recorded holder and the legal basis of succession. State whether the deceased left a Will and list every known heir, even if the applicant seeks entry only for a particular share.

  1. Jurisdiction check: Confirm the property’s tehsil and the revenue office responsible for the record. A Lucknow property is not necessarily filed at every office in the city; the land record controls jurisdiction.
  2. Application or report: File the mutation request under the applicable U.P. Revenue Code procedure and obtain acknowledgement, case number or online reference.

What happens when heirs dispute the mutation?

A revenue officer should not conduct a full trial on complicated title, validity of a Will, forgery, partition or competing sale deeds. The Allahabad High Court has repeatedly held that mutation entries do not create or extinguish title and have no presumptive value on ownership.

In Writ - B No. 3060 of 2023, Allahabad High Court, 29 Jan 2024, the Court reiterated that a mutation order remains subject to the decision of the competent civil court. A person claiming exclusive ownership may therefore need a suit for declaration, partition, cancellation, possession or injunction before the competent civil court.

In Writ - B No. 133 of 2024, Allahabad High Court, 1 Feb 2024, refusal to mutate on the basis of an unregistered Will was upheld on the facts before the Court. The ruling also recognised that the parties could establish their rights in a regular proceeding. The effect is practical: mutation may be refused without deciding the final title question.

A mutation application can face an additional problem when the property is mortgaged, attached or subject to an existing legal restriction. In Smt. Durgawati Upadhyay v. State of U.P. & others, 2024:AHC-LKO: not shown in snippet, the Allahabad High Court noted that mutation of mortgaged property could not be completed until the mortgage was redeemed and directed expeditious disposal of the pending matter.

If the revenue office does not act, first obtain the case status, order-sheet entries and proof of filing. A written request for disposal should identify the pending stage and attach the receipt. The High Court may consider an appropriate proceeding where there is unexplained delay, but it generally will not decide a complicated title dispute in a summary mutation case.

  2. Check the available statutory remedy, including correction, review, appeal or revision under the applicable revenue framework.
