How to Verify an Advocate's Bar Council Enrolment in Uttar Pradesh (and Spot a Fake Lawyer)

Two different documents get confused in client conversations, and both matter.

• Certificate of enrolment (Section 22, Advocates Act, 1961): issued by the State Bar Council when a person's name is entered on the roll of advocates. In Uttar Pradesh this is the Bar Council of Uttar Pradesh (office at 19, Maharshi Dayanand Marg, Prayagraj). The number (for example UP 4825-1999) is the permanent identity of the advocate on that roll.
• Certificate of Practice (COP): under the Bar Council of India Certificate and Place of Practice (Verification) Rules, 2015, an advocate must hold a valid, verified COP to continue practice. The COP (and its verification) is generally valid for five years and must be re-verified before it expires. Enrolment is lifetime membership of the roll; COP is the periodic confirmation that the person is still a practising advocate with current particulars.

A person who will not share an enrolment number, or who claims to be "from the High Court" without a Bar Council record, is not someone you should instruct. Paid directories are marketing; the statutory source is the State Bar Council roll.

Use the official Bar Council of Uttar Pradesh website (upbarcouncil.com). Menu items change over time, but the core tools are the advocate search / roll pages and the COP download or status tools. Work through the steps in order.

For common names, narrow the search with year of enrolment and father's name. Do not rely on a WhatsApp screenshot alone — the portal entry is the check that matters.

Here is how the process looks with a real number — mine — so you can see what "verified" means in practice, not in abstract marketing copy.

Anyone engaging this chamber should demand the enrolment number first, search the UP Bar Council portal, and only then discuss fees or strategy. A genuine practitioner has nothing to hide on the roll. The format is UP + serial + year of enrolment (related forms such as UP00498/91 also appear on the Council site). Claims of an "All India" licence without a State Bar Council number deserve extreme caution — enrolment is state-based under the Advocates Act.

Online verification is necessary but not always enough for High Court work. Add these local checks when hiring for the Allahabad High Court, Lucknow Bench.

• Chamber number: A real High Court practitioner will have a chamber (or a named senior's chamber) at the complex. Ask for the number and visit once. Chamber A-406 is where this practice sits; a mobile-only "address" is a warning sign.
• Oudh (Awadh) Bar Association: Advocates who regularly appear at the Lucknow Bench are typically members of the Oudh Bar Association. Membership is not a substitute for Bar Council enrolment, but enrolment plus chamber plus membership is the normal profile of someone who actually appears.
• Written vakalatnama: Authority to appear is conferred by a signed vakalatnama (or equivalent court form), not by a verbal promise at the gate. Never pay a full fee in cash to a stranger who will not put the engagement in writing.

These checks take an afternoon and cost less than one fee paid to a tout who cannot file a petition.

From practice at the Lucknow Bench, these patterns repeat. Any one of them is a reason to walk away and re-verify.

• No enrolment number on request — a genuine advocate can recite or show the number in seconds. Refusal, delay, or "the clerk has the card" without follow-up is a stop signal.
• No written vakalatnama — if they will not take a signed vakalatnama (or the court-prescribed form) and will only take cash "to manage the file", you are not hiring a counsel; you are funding a middleman.
• Cash-only, no receipt, full fee at the gate — a receipt or written fee memo is normal. Full upfront payment to someone with no chamber and no enrolment number is high risk.
• Influence claims — "judge's relative" or "reader's contact" stories are classic tout language, not enrolment.
• Directory rank as proof — "No. 1 on Google" is not a Bar Council certificate. Rankings are marketing; the roll is law.
• Wrong court name — there is no separate "Lucknow High Court". The correct description is Allahabad High Court, Lucknow Bench. Persistent wrong naming is a soft signal of a non-practitioner selling services online.

If an FIR is already registered and someone is pressuring you at the gate, pause, verify enrolment, then discuss FIR quashing or bail. Speed matters; panic hiring does not.

Use this short checklist in the first meeting. Honest answers are more useful than polished marketing.

1. What is your full Bar Council of Uttar Pradesh enrolment number and year?
2. May I photograph the enrolment / COP card (or verify it on upbarcouncil.com while we sit here)?
3. Where is your chamber, and which bar association are you a member of for this court?
4. Who will actually draft and argue — you, a named junior, or an unnamed "team"?
5. What is the fee structure in writing (filing, appearance, final hearing), and what is not included?
6. What is a realistic range of outcomes for my facts — not a guarantee?
7. Will you issue a vakalatnama and keep me copied on filings and orders?
